What happens next?
After detention or arrest, the police will report to the Procurator Fiscal who decides whether or not to bring criminal proceedings against you. You may be released and ordered to attend a hearing at a later date.
If you are being held in custody, you will appear at your hearing from custody on the next court day.
At your hearing, the Sheriff will consider bail. Your lawyer will address the court and give reasons as to why bail should be granted.
Where you are released from custody, you will be given a charge sheet or an indictment which outlines the details of the crimes you have been charged with. It will also set a date for when you must appear in court.
